BART shooting update: Mehserle intended to fire TASER not pistol

Michael Rains, attorney for former BART police officer Mehserle, gave some indication of his defense during the bail hearing last Friday, January 30.  He stated that Mehserle intented to fire his TASER, not his pistol and pointed out that the other officer, Pirone, heard Mehserle say, “I’m going to tase him.”  However Judge Morris Jacobson appeared skeptical pointing out the statement Mehserle made to Pirone right after the shooting, “I thought he was going for a gun.”  The judge felt that statement was inconsistent with Mehserle’s current statement that he intented to use his TASER.

Bail was set at three million dollars because the judge felt Mehserle was a flight risk.  He based that statement on Mehserle’s flight to Nevada after the shooting.  Mehserle has stated in the past he took his family to Nevada because of death threats.  Twice since the shooting, suspicious packages have appeared at Mehserle’s house that were later detonated by the bomb unit.
